License:

Subject to these terms and conditions, we grant you a non-exclusive, non-transferable, limited license to domownload, install, and use the App for your personal, non-commercial use on a single mobile device owned or otherwise controlled by you (“the Device”). The license is granted solely for the purpose of enabling you to use the App in accordance with these terms and conditions.

User is not allowed to:

* Modify, copy, distribute, transmit, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products, or services obtained from the App without Binganet Tech prior written consent.

* Use the App for any purpose that is unlawful or prohibited by these terms and conditions or National e-learning laws:

* Attempt to gain unauthorized access to any portion of the Binganet App or any other systems or networks connected to the App.

* Interfere with or disrupt the operation of the Binganet App or any servers or networks connected to the App.

Binganet Tech reserve all rights not expressly granted to you in these terms and conditions. We may terminate this license at any time and for any reason without notice or liability.

Your use of the Binganet App is subject to our Privacy Policy, which is incorporated into these terms and conditions by reference. By using the App, you consent to the collection, use, and disclosure of your information in accordance with our Privacy Policy.

User Account Registration:

• To create a user account on Binganet App, user must provide a valid email address, institution, current academic level and a password. User may also be required to provide additional information, such as your name etc.
• Users are responsible for maintaining the confidentiality of their password and for all activities that occur under their account. User must notify Binganet Tech immediately, if user become aware of any unauthorized use of his/her account.

Account Information:

• Users agree to provide accurate, current, and complete information when creating user’s account.
• Users are responsible for updating his/her account information to keep it accurate, current, and complete.
• Binganet may suspend or terminate users account if believed that the information user provide is inaccurate, outdated, or incomplete.

User Account Security:

• User are solely responsible for maintaining the security of his/her account and for any actions that occur under your account, whether or not authorized by you.
• User agree to notify Binganet Tech immediately of any unauthorized access to or use of his/her account.
• Binganet Tech is not responsible for any loss or damage arising from your failure to comply with these security obligations.

Account Termination:

• User may terminate his/her account at any time by contacting Binganet Tech via contact us on the mobile App.
• Binganet Tech reserve the right to suspend or terminate users account at any time and for any reason, including if Bingahet Tech believe that you have violated these terms and conditions or if Binganet Tech no longer wish to provide the App to you.

Data Privacy:

• Binganet Tech collect and use your personal information in accordance with her Privacy Policy. By using the App, user consent to Binganet Tech collection and use of user’s personal information as described in the Privacy Policy.
•  Users responsible for maintaining the confidentiality of their personal information, including their password, and for any actions that occur under their account.

Changes to Terms and Conditions:

Binaganet Tech reserve the right to change these terms and conditions at any time and for any reason. If we make any changes, we will notify you by email or by posting a notice on the App. Users continued use of the App after the effective date of the changes constitutes your acceptance of the changes.

INSTRUCTORS/LECTURERS Content Rights and Restrictions

Content Ownership and Responsibility:

* Instructors/lecturers retain ownership of all content, including text, images, videos, and audio, that they upload, create, or share on the Binaganet App.

Instructors/Lecturers are responsible for the legality, accuracy, and appropriateness of their content.

License to Use  Instructors/lecturers Content:

By posting or submitting content, Instructors/lecturers  grant the Binaganet Tech a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Binganet app and its promotion.

Privacy Considerations:

Instructors/lecturers should not post personal information or private content about others without their consent.

 Instructors/lecturers should be mindful of the privacy settings when sharing content on the Binganet app.

Copyright Protection:

Instructors/lecturers should not post content that infringes on the copyright, trademark, or other intellectual property rights of others.

The Binaganet Tech reserve the right to remove or disable access to any content that violates copyright laws.

Prohibited Content:

 Instructors/lecturers should not post content that is defamatory, obscene, pornographic, or otherwise offensive.

Users should not post content that promotes illegal activities or violates any laws or regulations.

Reporting and Removal:

Users can report content that they believe violates the terms and conditions or infringes on their rights.

The Binaganet Tech reserve the right to remove or disable access to any content that violates the terms and conditions or infringes on the rights of others.

Indemnification:

Users agree to indemnify and hold harmless the Binaganet Tech from any claims, damages, or losses arising from their content or their use of the app.

Changes to User Content Guidelines:

The Binaganet Tech reserve the right to change the user content guidelines at any time without notice.

Governing Law:

Any disputes will be resolved in the courts of [jurisdiction].

Payment Terms:

Revenue Share: The Binaganet app generates revenue primarily through advertisements displayed to users. The generated revenue is shared between the instructors, the instructions, the students and for app maintenance, respectively. The Binaganet Tech reserve the right to determine the revenue share percentage, which may vary depending on various factors, including but not limited to user engagement, content contribution, and overall app performance.

Eligibility for Payments: Users must meet certain criteria to be eligible for payments. These criteria may include, but are not limited to, the following:

* Users must have a registered account with the Binaganet app.

* Users must comply with the Binaganet app’s terms and conditions, including any guidelines for content contribution and community standards.

* Instructors/lecturers or students revenue is a function of of impression generated.

* Users must have accrued a minimum threshold amount before becoming eligible for payment. The threshold amount and payment frequency will be determined by the Binaganet Tech and may be subject to change with or without notice. Instructions would be paid in every three months in form of Research and development fund, instructors would be paid in every two months in the form of Intellectual fund and the students would be paid at point of graduation in the form of entrepreneurship fund.

Payment Process: Payments to eligible users will be processed on a regular basis as stated above. The payment process may involve the following steps:

* Eligible users will be notified when a payment is scheduled.

* Users must provide accurate and up-to-date payment information, such as bank account details, to receive payments.

* Payments will be made in the form of electronic funds transfer (EFT) or through a third-party payment processor, as determined by the Binaganet Tech.

* Payments may be subject to processing fees or currency conversion fees, which will be deducted from the payment amount.

* Users are responsible for any taxes or fees associated with receiving payments, and the Binaganet Tech will not be liable for any such taxes or fees.

Payment Disputes: In the event of a payment dispute, users must notify the Binaganet Tech within a reasonable timeframe. The Binaganet Tech will investigate the dispute and may request additional information from the user to resolve the issue. If the dispute is resolved in the user’s favor, the app’s owners will issue the appropriate payment or credit to the user’s account.

Changes to Payment Terms: The Binaganet Tech reserve the right to change the payment terms at any time, with or without notice to users. Changes to the payment terms may include, but are not limited to, changes in the revenue share percentage, payment thresholds, or payment frequency.

Termination of Payments: The Binaganet Tech reserve the right to terminate payments to users at any time, without notice, for any reason. Reasons for termination of payments may include, but are not limited to, violation of the app’s terms and conditions, fraudulent activity, or abuse of the payment system.
